Jailbreaking an iPhone constitutes copyright infringement and a DMCA violation, says Apple in comments filed with the Copyright Post as part of the 2009 DMCA triennial rulemaking. This marks the first formal public statement by Apple about its licit stance on iPhone jailbreaking.
Apple's iPhone, now the best-selling cellular phone in the U.S., has been designed with restrictions that baulk owners from running applications obtained from sources other than Apple's own iTunes App Store. "Jailbreaking" is the position used for removing these restrictions, thereby liberating your phone from Apple's software "jail." Estimates put the many of iPhone owners who have jailbroken their phones in the hundreds of thousands.
As part of the 2009 DMCA rulemaking, EFF has asked the Copyright Employment to recognize an exemption to the DMCA to permit jailbreaking in order to allow iPhone owners to use their phones with applications that are not to hand from Apple's store (e.g., turn-by-turn directions, using the iPhone camera for video, laptop tethering).
Apple's copyright contravention claim starts with the observation that jailbroken iPhones depend on modified versions of Apple's bootloader and operating system software. Actual enough -- we said as much in our technical white paper describing the jailbreak process. But the courts have dream of recognized that copying software while reverse engineering is a fair use when done for purposes of fostering interoperability with independently created software, a firmness of law that Apple conveniently fails to mention.
As for the DMCA violation, Apple casts its lot with the likes of laser printer makers and garage door opener companies who establish that the DMCA entitles them to block interoperability with anything that hasn't been approved in advance. Apple justifies this by claiming that chance the iPhone to independently created applications will compromise safety, security, reliability, and swing the doors substantial for those who want to run pirated software.

But we'd never accept this corporate paternalism as a justification for welding every car hood bolt and imposing legal liability on car buffs tinkering in their garages. After all, the culture of tinkering (or hacking, if you on the side of) is an important part of our innovation economy.
Of course, many iPhone owners will be happy to choose solely from the applications that Apple is zealous to approve, just like many Ford owners are happy relying exclusively on their local Ford supplier. But if you want to pop the hood, the DMCA surely shouldn't stand in your way.

I have an HTC Allude to Smartphone through US Cellular and for the life of me I cannot find out how to use the GPS capabilities for apps like Google Maps, Yahoo! GO, even Microsoft's Bing aid won't recognize the GPS. Any suggestions?

I have Us cellular and I was wondering if they would protection me for using myxer. I don't have internet on my phone, so i just use my internet at home and have it sent to my phone via pic communiqu. I know myxer won't charge me but will US Cellular? (US cellular has free incoming messages)
If so does anyone know how much??

CHICAGO -- The beginning results certainly were worth the wait.
After more than three months of time away from the Majors, after having a conceivably fast-moving injury rehab assignment for a partially torn tendon in his above-board ankle derailed for more than two weeks by a line drive off of his pitching elbow, Jake Peavy made his Chaste Sox debut Saturday night at U.S. Cellular Field against the Royals. And he accomplished pretty much what the White Sox had hoped, if not a bit more, in the South Siders' 13-3 cakewalk before 28,329.
As Peavy sharp out after his victorious return, Saturday's effort stands as just the beginning of what should be an entertaining run on the South Side.
"I did some things well, and I did some things not so well. I have a large way to go to be where I want to be," said Peavy, speaking in the U.S. Cellular Conference and Learning Center, with fireworks active off outside of the stadium. "But I'll take my chances with 13 [runs] any time.
"Once you get out there, it is like riding a bike. It comes back to you. You certainly are amiable in that surrounding, and I'm going to get better.
"Arm strength is going to get better," Peavy said. "I'm acclimated to to having more arm strength and having a little more giddy-up. It will all come in time. I'm not so sure how it will hit along this year, because I'm so far behind, but it felt good to get out there and compete."
